General Terms and Conditions "Try me for free" promotion.
GENERAL TERMS AND CONDITIONS OF USE OF THE WEBSITES AND/OR CONTENTS
1. COMPANY ORGANISING THE PROMOTION
CERVEZAS VICTORIA 1928, S.L. (“VICTORIA”), with Spanish Company Tax Number B66484528, with registered office in Malaga at Avda. Velázquez, nº 215, plans to carry out a promotion which will be performed in accordance with the following terms and conditions.
VICTORIA has contracted the agency DOCTOR WATSON COMUNICACIÓN S.L. (the “AGENCY”), which has its registered office in MALAGA at Calle Barroso nº10 2ºD and has Spanish Company Tax Number B93015840, to carry out the services and functions set out in these Terms and Conditions.
2. TERRITORIAL SCOPE OF THE PROMOTION AND ELIGIBLE PERSONS
The PROMOTION is open to end consumers who buy at least 1 pack of 6 25 cl bottles or 6 33 cl cans of VICTORIA beer and who comply with the requirements stipulated in these Terms and Conditions.
Only persons aged 18 and over and resident in Spain, excepting the provinces of Malaga, may participate in the PROMOTION.
Employees of S.A. DAMM and/or distributors or members of their families, together with all persons related directly or indirectly to the creation and carrying out of the PROMOTION, are expressly excluded from the PROMOTION.
Entries that do not comply with all these requirements will be automatically excluded, even if they are winning entries.
3. DURATION OF THE PROMOTION
The PROMOTION will start on 1 March 2021 and it will end when 3,000 valid entries have been received and/or on the closing date for entries, which is 30 December 2021.
4. PROMOTION MECHANICS AND GIFTS.
Within the stipulated period of the promotion, for the purchase of 1 pack of 6 25 cl bottles or 6 33 cl cans of Victoria beer which is recorded in a single purchase receipt, the amount set out below will be refunded to the user who complies with the promotion mechanics and the other terms and conditions set out herein.
In order to collect the amount stated in the receipt for the purchase of Victoria beer, the user must access the promotional website www.pruebavictoria.es, where he must register his personal data, attach a copy of the purchase receipt where it can clearly be seen that the purchase was made in accordance with the terms and conditions stipulated herein, and he must accept those terms and conditions. If the purchase receipt does not show the brand description (Cervezas Victoria), an image of the product must be attached together with the purchase receipt.
In order for a purchase receipt to be considered valid, the place of purchase must be clearly visible. If the purchase is online, the purchase receipt must show the postcode to which the shipment was sent.
The amount of €2.89 will be refunded for the purchase of a pack of 6 25cl units of Victoria per person (Spanish National Identification Document) and purchase receipt or the amount of €3.42 will be refunded for the purchase of a pack of 6 33 cl can units per person (Spanish National Identification Document) and purchase receipt. Only one entry per Spanish National Identification
Document and bank account number is valid in this promotion.
The refund will be paid into the bank account number that has been supplied.
Once the registration process has finished the entry will be validated in a maximum of 5 working days, and in a period of 15 working days from the date of confirmation of the validation the purchase amount will be refunded to the participant by transfer to the bank account stated in the entry form.
S.A. DAMM reserves the right to request the original purchase receipt uploaded at the time of registration. If it has been altered, is a photocopy or has been lost, or if the purchase receipt has been used to participate in other promotions which S.A. DAMM may carry out at the same time as this promotion or it does not comply with any requirement set out in these Terms and Conditions, the user will not have the right to a refund of the money spent on the purchase of Victoria beer.
5. LIABILITY
S.A. DAMM is not liable for incidents and occurrences of any kind which are caused by a failure of the computer program, where applicable, due to an event of force majeure (for example, inability to register a user, interruption or loss of a call, etc.) or incidents that derive from events of force majeure arising from causes such as a breakdown in the telephone, computer or electrical network caused by natural external agents (atmospheric or climatological) or by the deficient performance of the companies supplying those services.
Furthermore, S.A. DAMM is not liable for the impossibility of registering a user due to an error in the entering of his personal details which is the result of entering information that is intangible, incomplete, erroneous or false.
LIkewise, S.A. DAMM is not liable for incidents that derive from which arise from events of force majeure arising from causes such as a breakdown in the telephone, computer or electrical network caused by natural external agents (atmospheric or climatological) or by the deficient performance of the companies supplying those services.

7. DATA PROTECTION
By the promotional mechanics described, and in compliance with the applicable law, participants in this promotion are informed that their data will be processed by SA DAMM for the purposes of managing this promotion and assigning the prizes to the corresponding winners of it.
Furthermore, by completing the entry form for this promotion, the participant gives his express consent to the processing of his personal data in order to manage, attend to and provide him with the services requested in accordance with the information supplied at the time of registering in this promotion as regards purpose, legitimacy and recipients of the data.
The fields marked with an asterisk in the above-mentioned entry form are strictly necessary in order to be able to participate in this promotion.
Participants in this promotion may exercise their rights of access, rectification, deletion and portability of their data, as well as the restriction of or objection to its processing, by writing to the following postal address: S.A. 8. RESERVATIONS AND LIMITATIONS
S.A. DAMM reserves the right to annul this promotion or to suspend it, or to change any of its terms and conditions if for technical reasons or reasons of any other nature beyond its control it cannot accomplish the normal carrying out of this promotion in accordance with these Terms and Conditions.
Furthermore, S.A. DAMM may declare this promotion void if it detects irregularities in the identification data of the user.
S.A. DAMM is not liable for the veracity of the data supplied by the user.
S.A. DAMM reserves the right to remove, with justification, any user who defrauds, alters or disables the proper functioning and normal and regulatory course of this promotion.
9. APPLICABLE LAW AND JURISDICTION
The promotions of S.A. DAMM are governed by Spanish law.
For the purposes of any dispute that may arise over the interpretation and application of these Terms and Conditions, both S.A. DAMM and the participants in this promotion submit to the
jurisdiction of the competent courts and tribunals.
S.A. DAMM reserves the right to take legal action against persons who carry out any type of act that may be considered manipulation or falsification of this promotion.
10. ACCEPTANCE OF THE TERMS AND CONDITIONS
Potential participants are informed that the mere fact of taking part in this promotion implies full acceptance of these Terms and Conditions. Any declaration to the contrary by the participant will entail his exclusion from this promotion and S.A. DAMM will be released from performance of the obligation contracted with the participant.
The terms and conditions of this promotion are deposited with the notary public of Barcelona, Mr Jose-Alberto Marín Sánchez, calle Diputació, 268, entlo, where they are freely available to consumers.
